Farmington Woman Charged With DWI, Child Abuse After Allegedly Driving With Child

FARMINGTON — A Farmington woman has been charged with driving while under the influence and child abuse after police alleged she drove with a young child in the vehicle during a May 14 incident, according to court records.

Nikita Charlita Rose, 36, is charged in Farmington Magistrate Court with one count of abuse of a child not resulting in death or great bodily harm and one count of driving while under the influence (.08 or above).

All charges are allegations based on court records, and the defendant is presumed innocent unless proven guilty in a court of law.

According to a statement of probable cause filed by Farmington police, officers were dispatched shortly after midnight to a residence on North Fairview Avenue in reference to a possible DWI investigation.

Police alleged the reporting party told officers Rose returned from doing laundry and appeared intoxicated while caring for a 3-year-old child. Court records state the reporting party alleged Rose had been driving with the child in the vehicle.

According to the affidavit, Sgt. B. Warman observed Rose seated in the driver’s seat of a Jeep in the parking lot when officers arrived. Police reported detecting the odor of an alcoholic beverage after contacting her.

Court records state Rose allegedly admitted she had consumed alcohol before driving. Investigators alleged she later told officers she consumed additional alcohol after returning from the reservation earlier that evening.

According to the affidavit, officers administered standardized field sobriety tests and reported observing multiple indicators of impairment. Police alleged Rose showed signs of impairment during the horizontal gaze nystagmus, walk-and-turn, and one-leg-stand tests.

Police alleged Rose later provided breath alcohol concentration readings of 0.16 and 0.14 at the Farmington Police Department.

Case Status

Court records indicate Rose was booked into the San Juan County Adult Detention Center following her arrest. Online court records did not indicate whether she had retained legal counsel as of Friday.
