A 20-year-old Farmington man has been charged with homicide by vehicle while allegedly driving under the influence following a rollover on Wildflower Parkway in which a woman died, according to a criminal complaint and statement of probable cause.
Christopher Adam Gutierrez, 20, was arrested Oct. 3 and is also charged with aggravated DWI for allegedly refusing testing, reckless driving, concealing identity and resisting, evading or obstructing an officer, court records state.
All charges are allegations based on court records, and the defendant is presumed innocent unless proven guilty in a court of law.
According to the probable cause statement, a Farmington police officer was dispatched at approximately 12:52 a.m. Oct. 3 to Wildflower Parkway after a caller reported that a vehicle had rolled over.
The officer reported finding a white GMC truck in a dirt area partially up a hill south of the roadway. According to the statement, Gutierrez was in the driver’s seat and appeared to be revving the engine as the officer approached.
The officer reported finding a woman who appeared to be pinned beneath the truck and requested that medics expedite their response. Firefighters worked to remove her, according to the statement. She was transported to San Juan Regional Medical Center, where the probable cause statement says she was pronounced dead shortly after arriving.
According to the probable cause statement, a witness said the truck was traveling east on Wildflower Parkway at a high rate of speed before swerving onto a curb and rolling. The witness described the crash as happening “extremely fast” and told police she could not determine how many people were inside the truck. A separate reckless-driving citation alleges Gutierrez drove at a high rate of speed without regard for the roadway’s curvature before swerving onto a curb, entering the dirt and rolling.
According to the probable cause statement, the officer instructed Gutierrez to stop revving the engine, place the truck in park and exit. Police allege Gutierrez initially complied but then moved toward the rear of the truck. The officer reported that Gutierrez became verbally combative as the officer approached.
Additional officers arrived and placed Gutierrez in handcuffs, the statement says. Police allege he resisted by pulling his arms away. The responding officer also reported that Gutierrez appeared unsteady on his feet, had bloodshot and watery eyes and had what the officer described as an odor of an intoxicating beverage coming from his exhaled breath.
Police allege Gutierrez refused testing after he was transported to San Juan Regional Medical Center. The probable cause statement says an officer obtained a court-authorized warrant for a blood draw after Gutierrez allegedly said he would refuse the draw and resist if officers attempted it.
According to the statement, officers and hospital staff assisted while the blood draw was completed at approximately 3:42 a.m. Police allege Gutierrez continued resisting officers and hospital staff during portions of the process.
A separate DWI citation records an alleged refusal of testing and states that a blood warrant was later executed. The citation also notes that the crash resulted in a death.
