A Shiprock man has been charged with attempted breaking and entering and battery after deputies alleged he tried to enter a cabin at a Kirtland RV park, according to a criminal complaint and statement of probable cause.

Leondre J. Begay, 26, of Shiprock, was arrested Sept. 7 after San Juan County sheriff’s deputies responded to an RV park in Kirtland, according to court records. All charges are allegations based on court records, and the defendant is presumed innocent unless proven guilty in a court of law.

According to the probable cause statement, a deputy was dispatched shortly before 5:40 a.m. after a report of an active physical fight that may have begun as a breaking-and-entering incident. Dispatch advised that a man later identified as Begay was allegedly trying to get into a residence at the RV park and that several people were attempting to hold him down.

The deputy reported arriving to find Begay lying face down on a gravel roadway between cabins and RVs. According to the probable cause statement, two men were restraining him while a third man stood nearby attempting to assist. The deputy reported approaching Begay and placing him in handcuffs while he allegedly yelled, kicked and struggled.

The probable cause statement says Begay appeared heavily intoxicated and struggled to listen or answer questions. The deputy reported that Begay had scrapes on his face and blood on his face and shirt and that medical personnel were called to check him. According to the statement, Begay later declined medical treatment.

The deputy wrote that she was concerned Begay may have mistaken the residence for where he was staying. According to the probable cause statement, Begay gave varying answers while the deputy attempted to determine where he was staying and where his sister lived.

Investigators then interviewed several people who had been at the RV park. According to the probable cause statement, one resident reported Begay had been around the RV park while appearing heavily intoxicated and later returned to the cabin.

The resident told deputies that she later heard knocking at the cabin door followed by louder, rapid knocking, according to the probable cause statement. She alleged Begay was attempting to get into the cabin while she told him to leave. The statement says she reported that Begay tried to use the front-door keypad during the incident.

According to the probable cause statement, the resident and the deputy checked the property after the confrontation and reported finding no damage to the windows or doors.

The probable cause statement also describes a confrontation between Begay and several people who were attempting to get him to leave. The man identified in the battery allegation told deputies that Begay initially threw two punches toward him and missed both, according to the statement.

That witness also told deputies that Begay later grabbed onto him after the confrontation moved away from the front porch toward the gravel roadway, according to the probable cause statement. The criminal complaint separately alleges Begay unlawfully touched or applied force to that man in a rude, insolent or angry manner.

Deputies reported that Begay remained agitated after being placed in a patrol vehicle. According to the probable cause statement, he allegedly kicked and struck the vehicle’s interior and continued yelling while being transported. The statement says he was taken to the San Juan County Adult Detention Center in Farmington.

The criminal complaint identifies breaking and entering as the underlying felony offense and classifies the attempted offense charged in this case as a misdemeanor.
