FARMINGTON — A Farmington man has been charged with aggravated burglary and aggravated assault after police alleged he threatened a resident with a box cutter during a disturbance at an apartment complex, according to a criminal complaint filed in Farmington Magistrate Court.
Michael Andrew Anderson, 37, faces one count of aggravated burglary, one count of aggravated assault with a deadly weapon and two misdemeanor counts of criminal damage to property in connection with the May 16 incident at the Wild Goose Apartments in Farmington.
All charges are allegations based on court records, and the defendant is presumed innocent unless proven guilty in a court of law.
According to a statement of probable cause, officers were dispatched shortly before 10 p.m. after a resident reported a disturbance involving a box cutter at the apartment complex.
Police identified the reporting party in court records, but San Juan Pulse is not naming him because he is a private resident and alleged victim.
Officer Dylan Goodluck wrote in the affidavit that officers encountered Anderson outside apartment units 111 and 114 and detained him after observing what the report described as a box cutter clip protruding from his pocket. According to the affidavit, officers recovered a box cutter from Anderson’s pocket and directed him to sit down while they investigated.
According to the affidavit, the resident told police Anderson entered his apartment without permission and held a box cutter within inches of his neck during an argument. The resident reportedly told officers he was not cut during the incident.
According to the report, the resident also alleged Anderson damaged tires on an electric bicycle parked outside the apartment. Police also alleged Anderson damaged flower pots belonging to another resident outside the complex.
The affidavit states officers photographed the alleged damage and collected the box cutter as evidence.
According to the criminal complaint, Anderson is accused of becoming armed with a box cutter after entering the apartment without authorization, leading to the aggravated burglary charge. Court records state the aggravated burglary charge is a second-degree felony, while the aggravated assault charge is a fourth-degree felony.
