An Aztec man has been charged with aggravated driving while under the influence, shoplifting and other offenses after an alleged crash and shoplifting incident at a Speedway convenience store in Farmington, according to a criminal complaint filed in San Juan County Magistrate Court.
Mataius Oros, 20, of Aztec, was arrested May 5, according to court records.
All charges are allegations based on court records, and the defendant is presumed innocent unless proven guilty in a court of law.
According to a statement of probable cause filed by Farmington police Officer Jeremy Cook, officers were dispatched at about 2:36 a.m. May 5 to Speedway at 2700 West Main St. after a report that a male subject had stolen items from the store and left in a black SUV.
Police allege the SUV later crashed into a trailer at Farmington RV Sales, 1603 West Main St., before two occupants exited the vehicle and walked away toward Apache Street.
The affidavit states officers later located Oros and another man near Apache Street. Police reported that Oros matched the description provided by a Speedway employee and surveillance footage.
A Speedway employee told police that a man later identified as Oros allegedly entered the store, took two burritos from a refrigerated case, heated them in a microwave and left with the food and several bags of chips without paying, according to court records.
Investigators alleged surveillance footage showed the SUV’s driver entering the store before leaving the parking lot at a high rate of speed.
Police reported finding an open container of Canadian Mist alcohol inside the SUV and alleged that a portion of its contents was missing, according to court filings.
The affidavit states Oros admitted to officers that he had been a passenger in the SUV and had consumed alcohol that day. Police also alleged he showed signs of intoxication, including bloodshot watery eyes, slurred speech and the odor of alcohol.
According to the affidavit, Oros denied driving the SUV and told officers another person had been behind the wheel.
The affidavit states Oros declined to submit to chemical testing after being read the New Mexico Implied Consent Advisory.
Police alleged Oros had been driving the SUV and left the scene without notifying law enforcement.
