Farmington case involving minor allegation dismissed by prosecutors

A Farmington man previously charged in a child sexual contact investigation has had the case dismissed after prosecutors filed a nolle prosequi motion in San Juan County Magistrate Court, according to court records.

Chad Uselman was identified as the defendant in the case, which had been pending under case number M-047-FR-2026-00202. Court filings show the State of New Mexico moved to dismiss the charge on April 22, 2026, stating the action was taken “in the best interest of justice.”

A nolle prosequi is a formal notice by prosecutors that they are discontinuing the case.

According to a statement of probable cause, the highest charge filed in the case was criminal sexual contact of a minor. The allegation involved reported inappropriate touching over clothing, according to court records.

Earlier filings indicate Uselman, through his attorney, waived his first appearance and requested a preliminary examination. Additional documents show a motion had been filed seeking to allow him to be booked and released on his own recognizance under standard conditions, which prosecutors did not oppose.

A judge subsequently granted the request to set the case for a preliminary hearing, according to court records.
