Items taken after move-out turn up for sale online

AZTEC, N.M. — Court records allege a former tenant removed multiple items from an Aztec residence after moving out, leading investigators to seek an arrest warrant for felony larceny.

The allegations are outlined in a sworn affidavit for arrest warrant filed Jan. 20, 2026, in Aztec Magistrate Court.

Former tenant accused of removing property

According to the affidavit, deputies were dispatched on Jan. 12, 2026, to a residence near Road 3136 in reference to a reported larceny.

Court records state the reporting party told deputies that a former tenant, Timothy Fowler, had taken multiple items from the residence after moving out.

According to the affidavit, the tenant had lived at the residence for several years and had recently relocated to another property. Deputies were told the individual had been allowed to remain at the home temporarily due to prior work arrangements and was expected to remove only personal belongings.

Items reported missing

After the tenant moved out, the reporting party later discovered numerous items missing from the home, according to court records.

The affidavit lists the missing items as including a cast iron wood-burning stove, compact discs, Pyrex dishware, multiple afghan blankets, vintage vehicle window regulators, and a vintage Thermos.

Court records state the combined value of the reported missing items exceeded $500, meeting the threshold for felony larceny under New Mexico law.

Online listings referenced

According to the affidavit, the reporting party later observed items believed to have been taken from the residence listed for sale on an online marketplace account associated with Fowler.

Court records state the account included listings that matched multiple items reported missing. Screenshots of the listings were collected and logged into evidence.

Statements to deputies

When contacted by deputies, Fowler told investigators he buys and sells items frequently and believed some of the property belonged to him.

According to the affidavit, Fowler stated that other items may have been mixed together because belongings from multiple individuals were stored at the residence. He also told deputies he would be willing to return items if provided with a list of property believed to be missing.

Charge sought

Felony larceny allegation

Based on the investigation, deputies requested an arrest warrant charging Fowler with larceny over $500, a felony offense under New Mexico law.
