5-Year-Old Passenger Alleged in DWI Traffic Stop Near East Main in Farmington

FARMINGTON, N.M. — Court records allege a Farmington traffic stop led to multiple charges after an officer reported signs of impairment and said a 5-year-old child was riding in the vehicle. The allegations are detailed in a statement of probable cause tied to charges filed in Farmington Magistrate Court. Authorities allege the driver, Anthony Miramontes, also had a revoked license at the time of the stop.

What Court Records Allege

Traffic Stop Initiated After Speed Estimated Above Posted Limit

According to the statement of probable cause, a Farmington police officer was conducting traffic control near the intersection of East Main and 20th Street on Feb. 7 at about 9:09 p.m. The affidavit states the officer observed a Chevy pickup traveling at a high rate of speed and estimated it was going 58 mph in a posted 35 mph zone.

Court records state the officer activated emergency lights and sirens and the vehicle pulled over near 3060 E. 20th St. The affidavit lists the vehicle as bearing a New Mexico license plate.

Officer Reports Signs of Impairment During Contact With Driver

The officer reported contacting the driver and advising him of the reason for the stop, according to the affidavit. The statement says the officer observed bloodshot, watery eyes and described the driver as appearing confused when asked about paperwork.

According to the document, the officer also detected the odor of an intoxicating beverage and said the driver initially denied drinking before admitting he had consumed alcohol. The affidavit states the driver was instructed to step out of the vehicle.

Records Check Alleged Revoked License and Interlock Requirement

Court records state the officer conducted a records check and was advised the driver had a valid-revoked license status. The affidavit further states the driver should have been operating only a motor vehicle with a properly installed ignition interlock device.

According to the statement, the driver was instructed to wait near the officer’s vehicle while the investigation continued, and the officer later advised the driver he was under arrest.

Field Sobriety and Breath Testing Alleged 0.08 and 0.07 Results

The affidavit states the officer administered standardized field sobriety tests and reported observing multiple clues of impairment. The statement alleges the officer also administered a preliminary breath test, which the officer said showed alcohol present.

According to court records, the driver was taken to the Farmington Police Department, where an Intoxilyzer 9000 test was administered. The affidavit states two breath tests recorded results of 0.08 and 0.07.

The affidavit states the driver was advised of Miranda rights and agreed to provide a blood sample for additional testing. Court records state a blood kit was collected and the driver was transported to San Juan Regional Medical Center for a blood draw.

Child Passenger Cited in Child Abuse Allegation

Authorities allege a 5-year-old passenger was in the vehicle during the traffic stop. The affidavit states the officer believed the driver was impaired and driving at a speed above the posted limit while the child was present, and that the ignition interlock device was not functioning properly.

Court records state the child was released to an adult relative at the scene.
