$1,575 SCRAM Monitor Removal Leads to Embezzlement-Related Charges in San Juan County

A San Juan County man has been charged with criminal solicitation to commit embezzlement and criminal damage to property after authorities reported a missing SCRAM alcohol monitoring device valued at $1,575, according to an affidavit for arrest warrant filed in Aztec Magistrate Court. Court records indicate the device had been assigned through pretrial supervision.

The affidavit states the charges were filed March 11, 2026, in Aztec Magistrate Court in San Juan County.

Deputy Contacted by Pretrial Services

According to the affidavit, San Juan County Sheriff’s Deputy Tanner Lusk reported that on March 4, 2026, at approximately 1:44 p.m., he was dispatched to a larceny call at the district court and was advised to contact a Pretrial Services employee.

The employee informed the deputy that Byron Toledo was currently booked at the San Juan County Adult Detention Center and had previously absconded from Pretrial Services and removed a SCRAM alcohol monitoring device.

The deputy wrote that he was asked to interview the defendant and inquire about the whereabouts of the device.

Interview at Detention Center

According to the affidavit, the deputy met with Byron Toledo in the booking area of the detention center after jail staff brought the defendant for questioning.

The deputy reported that he read the defendant a Miranda warning from his issued card and asked whether the defendant understood those rights, which the affidavit states he confirmed.

When asked about the SCRAM monitor, the affidavit states the defendant said he had been in Farmington, was intoxicated, and did not know exactly where he removed the device from his person.

Monitor Reported Missing

According to the affidavit, the defendant told the deputy he did not remember what he did with the device and only recalled removing it somewhere in Farmington. The affidavit states the defendant believed the removal occurred around mid-April 2025 but could not recall a specific date.

The deputy wrote that he later contacted Pretrial Services again and learned the SCRAM monitor’s serial number was 22711 and that the device had an approximate value of $1,575.

Based on the statement that the device had been removed and was no longer in the defendant’s possession, the deputy requested an arrest warrant for embezzlement-related charges and criminal damage to property.

In a separate case, seven embezzlement counts were previously filed in San Juan County, according to court records.
