Assault Allegation Tied to Confrontation Outside South Second Street Business in Raton

Court records allege a Raton man participated in an assault outside a South Second Street business while a minor was in his care. The case stems from a January incident investigated by Raton police and outlined in an affidavit for arrest warrant filed in Colfax County Magistrate Court. Authorities allege the incident involved multiple individuals and resulted in visible injuries to the reporting party.

Officer Responds to Reported Fight Near South Second Street

According to the affidavit, a Raton police officer was dispatched on Jan. 24 to the area of South Second Street for a report of an active fight involving multiple individuals. The location was described as a commercial area near a chemical supply business. Upon arrival, the officer encountered an adult male who appeared injured and had difficulty walking, court records state.

The affidavit states the individual reported needing medical attention and told officers he had been “jumped.” Emergency medical personnel were called to the scene, and the individual was later transported to a local medical center for evaluation and treatment of injuries described as consistent with blunt force trauma.

Alleged Identification of Suspects and Vehicle

While receiving medical care, the reporting party allegedly identified Jesse Ricardo Uribe as one of the individuals involved in the confrontation, according to court records. The affidavit states the reporting party also identified another adult male and described a lifted Ford diesel pickup truck associated with the incident.

An officer documented the reporting party’s injuries using department-issued equipment, the affidavit states. Investigators later sought additional information to determine the sequence of events leading up to the reported assault.

Minor Interviewed After Being Brought to Police Department

Following the initial report, the affidavit states the officer contacted the minor’s foster parent and requested the minor be brought to the Raton Police Department for an interview. The interview occurred several hours later with a guardian present, after the minor was advised of his rights.

According to the affidavit, the minor denied knowledge of the reporting party being attacked but confirmed being with Uribe at the time. Officers observed what appeared to be offensive injuries on the minor’s hands, including marks on the knuckles. The affidavit states those injuries were photographed and were inconsistent with the minor’s explanation, but consistent with a physical altercation.

Video Evidence and Follow-Up Investigation

In follow-up investigations conducted days later, officers reviewed surveillance video provided by a third party, according to the affidavit. The footage allegedly shows the reporting party being chased by two individuals across a parking lot. One individual was identified by officers as Uribe based on clothing and prior identification.

Additional video from a nearby business was also reviewed, the affidavit states. That footage allegedly shows a pickup truck stopping near the reporting party before he runs across traffic, followed by the individuals seen pursuing him. Investigators allege Uribe allowed the minor in his care to participate in the alleged battery.

Charges Filed

Based on the investigation, authorities requested an arrest warrant for the following charges:

  • Contributing to the delinquency of a minor, a fourth-degree felony, contrary to NMSA 1978, Section 30-6-3
  • Battery, a petty misdemeanor, contrary to NMSA 1978, Section 30-3-4

The charges are allegations only. Prosecutors must prove each element of the offenses beyond a reasonable doubt in court.
